Overview

Construction Insurance Compliance Services, LLC (“Company”, “we”) is committed to protecting your privacy. This Privacy Statement describes the types of information we may collect from you or that you may provide when you visit the website, www.cicssolutions.com (the “Site”), including but not limited to the Align Analytics™ inspection data management platform, and our practices for collecting, using, maintaining, protecting, and disclosing that information. It does not apply to those websites, services and products that you may access from the Site, each of which may have its own privacy statements that differ materially from this Privacy Statement. Please read this Privacy Statement carefully to understand our policies and practices regarding your information and how we will treat it. By accessing and using the Site, downloading any materials from the Site, uploading any materials to the Site, or purchasing products or services from or through the Site, you acknowledge and fully understand this Privacy Statement and consent to the information collection and use practices described herein. If you do not agree to this Privacy Statement, do not use the Site, download any materials, upload any materials or purchase products or services.

Collection of your Personal Information

You do not have to provide us with your personally identifiable information to use this Site. However, certain services to which you may subscribe through the Site (e.g., Align Analytics) may require you to provide personally identifiable information, which is information that identifies a person as an individual, such as your name, company, and title, postal address, telephone number, or email address.

In order to access some areas of the Site, you will be asked to sign in with an e-mail address and/or log-in name and a password, which we refer to as your credentials. As part of creating your credentials, you may also be requested to provide questions and secret answers, which we use to help verify your identity and assist in resetting your password. Some services may require added security, and in these cases, you may be asked to create an additional security key.

Registration with us is mandatory to enable you to log into and use the features of Align Analytics. Your access to and use of Align Analytics will be subject to this Privacy Statement, the Terms of Use and Align Analytics User Agreement contained on the Site and any other written agreements between the Company and you. As part of your use of Align Analytics, authorized users will be able to post documents, photographs, inspection reports, agreements, schedules, plans and other materials and information (“User Content”) for analysis through Align Analytics. User Content will be maintained at Align Analytics, a secure, password protected platform.

If you purchase goods and services through the Site, we may also collect your personal financial information such as credit card information, related account and billing information, invoice related information and other data to process the order. We may also update such data should you grant us permission to bill you or your credit card for recurring charges. We may use the tools, software or services of third-party service providers, as identified on the Site, to process transactions on our behalf. Each of those third-party service providers have agreed to comply with this Privacy Statement and may have their own privacy policies, which you may review on their websites. All information of this nature is maintained by us in a secure database and transmitted using secure transmission encryption.

We may also collect demographic information, such as your postal code, age, gender, preferences, interests and favorites. We may collect information about your visit, including the pages you view, the links you click, and other actions taken in connection with the Site. We also collect certain standard information that your browser sends to every website you visit, such as your IP address, browser type and language, access times and referring website addresses. This information is used by us for the operation of the service, to maintain quality of the service, and to provide general statistics regarding use of the Site.

Please keep in mind that if you directly disclose personally identifiable information or personally sensitive data onto any public areas of the Site or through public message boards, this information may be viewed, collected and used by others. We encourage you to publish only information you are certain you want to be accessible to the public-at-large.

We encourage you to review the privacy statements of websites you choose to link to from the Site so that you can understand how those websites collect, use and share your information. We are not responsible for the privacy statements or other content on websites outside of the Site.

Use of your Personal Information

We collect personally identifiable information from you only when you voluntarily provide it to us. If and when it is collected, we may use personally identifiable information in the following ways:

  • Fulfillment of Requests and Communication. We process personally identifiable information to comply with your requests, respond to your inquiries, and send you documents, reports or other information, such as welcome letters, compliance reports, information on technical service issues, and security announcements. If you contact us through the Site, we may keep a record of your contact information and correspondence, and use it to respond to you. We will further use personally identifiable information to fulfill any other purposes for which it was provided, and as disclosed at the time the data is collected.
  • Internal Business Purposes. We may also use personally identifiable information about you for our internal business purposes, such as data analysis, audits, and other similar purposes.
  • Services. In addition to the purposes mentioned above, we may use personally identifiable information for the purposes of providing analytical reports, trending reports and other analysis related to the construction and insurance industries.

We collect and use your personal information to operate and improve the Site and deliver the services or carry out the transactions you have requested. These uses may include providing you with more effective customer service; making the Site or services easier to use by eliminating the need for you to repeatedly enter the same information; performing research and analysis aimed at improving our products, services and technologies.

We may disclose personal information that we collect or you provide to contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.

Content uploaded to Align Analytics will be used in the manner set forth in the Align Analytics User Agreement.

We do not sell, rent or lease our customer lists to third parties. We may, from time to time, contact you on behalf of external business partners about a particular offering that may be of interest to you. In those cases, your unique personally identifiable information (e-mail, name, address, telephone number) is not transferred to the third party. In addition, we may share data with trusted partners to help us perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services, and they are required to maintain the confidentiality of your information.

We may keep track of the websites and pages our customers visit at the Site, in order to determine what services are the most popular. This data is used to deliver customized content and advertising within the Site to customers whose behavior indicates that they are interested in a particular subject area.

We will disclose your personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to: (a) comply with any applicable law, regulation, legal process or governmental request; (b) enforce our Terms of Use including investigations of potential violations thereof; (c) detect, prevent, or otherwise address fraud or security issues; or (d) protect against harm to the rights, property or safety of the Company, users, you or the public.

Use of Cookies; Do Not Track

The Site uses "cookies" to enable you to sign in to our services and to help you personalize your online experience. A cookie is a text file that is placed on your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you and can only be read by a web server in the domain that issued the cookie to you.

The Site uses cookies to store your preferences and other information on your computer in order to save you time by eliminating the need to repeatedly enter the same information and to display your personalized content and appropriate advertising on your later visits to these sites. When you return to the Site, the information you previously provided can be retrieved, so you can easily use the features that you customized.

You have the ability to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser settings to decline cookies if you prefer. If you choose to decline cookies, you may not be able to sign in or use other interactive features of the services or websites you visit, including the Site.

Some browsers also have a “do not track” feature that lets you tell websites that you do not want to have your online browsing activities tracked. No uniform technology standard for recognizing and implementing “do not track” signals has been finalized. Therefore, at this time, we do not respond to browser “do not track” signals. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Statement.

Data Retention Policy

We will retain content posted to Align Analytics through the Site for an indefinite period of time.

Security of your Personal Information

We are committed to protecting the security of your personally identifiable information. We use a variety of security technologies and procedures to help protect your personal information from unauthorized access, use, or disclosure. For example, we secure the personally identifiable information you provide on computer servers in a controlled, secure environment, protected from unauthorized access, use or disclosure. When we transmit highly confidential information (such as a password or credit card information) over the Internet, we protect it through the use of encryption, such as the Secure Socket Layer (SSL) protocol. In addition, our business practices are reviewed periodically for compliance with policies and procedures governing the security and confidentiality of our information.

We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security. We are not responsible for circumvention of any privacy settings or security measures contained on the Site.

The safety and security of your information also depends on you. If a password is used to help protect your accounts and personal information, it is your responsibility to keep your password confidential. Do not share this information with anyone. If you are sharing a computer with anyone you should always choose to log out before leaving a site or service to protect access to your information from subsequent users.

Your California Privacy Rights

California law permits customers in California to request certain details about how their information is shared with third parties and, in some cases, affiliates, for those third parties’ and affiliates’ own direct marketing purposes. California’s “Shine the Light” law (Civil Code Section § 1798.83) may permit users of our Site who are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. This website does not provide services or products to children under the age of 18.

Merger, Sale or Bankruptcy

In the event the Company is acquired by or merged with a third-party entity, we reserve the right to transfer or assign the information we have collected from our users as part of such merger, acquisition, sale or other change of control. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors’ rights generally, we may not be able to control how your personal information is treated, transferred, or used. In any of the circumstances described in this paragraph, the information will be subject to the privacy policy of the purchaser or assignee.
